Medizinprodukt. In Erw\u00e4gungsgrund (19) der MDR hei\u00dft es:<\/span><\/p>\n<blockquote>\n<p><i><span style=\"font-weight: 400\">Software, die f\u00fcr medizinische Zwecke gem\u00e4\u00df der Definition eines Medizinprodukts bestimmt ist, gilt als Medizinprodukt. Software allgemeiner Art \u2013 auch wenn sie im Gesundheitsbereich verwendet wird \u2013 ist kein Medizinprodukt.<\/span><\/i><\/p>\n<\/blockquote>\n<p><b>Entscheidend ist also der \u201eVerwendungszweck\u201d (intended purpose)<\/b><span style=\"font-weight: 400\"> \u2013 wie vom Hersteller definiert.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Laut <\/span><b>Artikel 2 MDR<\/b><span style=\"font-weight: 400\"> ist ein Medizinprodukt:<\/span><\/p>\n<p><span style=\"font-weight: 400\">[\u2026] jedes Instrument, Ger\u00e4t, Software, Material oder sonstiger Artikel, das vom Hersteller f\u00fcr die Verwendung beim Menschen zu einem oder mehreren der folgenden medizinischen Zwecke bestimmt ist:<\/span><\/p>\n<p><span style=\"font-weight: 400\">Diagnose, Vorbeugung, \u00dcberwachung, Vorhersage, Prognose, Behandlung oder Linderung von Krankheiten, Verletzungen, Behinderungen [\u2026]<\/span><\/p>\n<p><span style=\"font-weight: 400\">Der definierte Zweck legt fest, ob und wie Software als Medizinprodukt eingestuft wird \u2013 und somit auch ihre Klassifizierung (I, IIa, IIb, III) und Komplexit\u00e4t des Zertifizierungsprozesses. Dieser Zweck muss klar, ehrlich und nachvollziehbar dokumentiert werden.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Bei Medical Scribes ist die Abgrenzung oft schwierig: Ist ein Transkript eines Gespr\u00e4chs reine Dokumentation \u2013 oder Teil der Diagnostik?
